1. Agreement to these terms
These Terms of Use ("Terms") form a binding agreement between you and California Airduct Pros ("California Airduct Pros," "we," "us," or "our") governing your use of the website at californiaairductpros.com (the "Site") and any enquiry, estimate request or service you request through it.
By using the Site, submitting a form, or requesting services from us, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Site.
Please note section 16. It contains an agreement to resolve disputes by binding individual arbitration and a waiver of class actions, and it affects how claims between us are resolved.
2. Who may use the site
You must be at least 18 years old and able to enter into a binding contract to request services or submit a form. By doing so you confirm that you meet those requirements, that the information you give us is accurate, and that any telephone number you provide is a number you own or are authorised to give consent for.
3. Our services and estimates
We provide air duct cleaning, dryer vent cleaning, chimney cleaning, chimney repair, chimney building, duct replacement, UV light installation, mold remediation and related indoor air quality services in the State of California.
Submitting a form on the Site is a request for an estimate. It does not create a contract for services and does not reserve an appointment. A contract is formed only when we confirm a scheduled appointment with you and you accept the price we quote.
Estimates given by telephone or online are preliminary and are based on the information you give us. The final price depends on what our technician finds on site, including the number and length of runs, the number of vents and returns, the condition and accessibility of the system, and any contamination that requires additional work. If the work required differs from the preliminary estimate, we will tell you the revised price before starting, and you may decline without charge.
Estimates are valid for 30 days unless we state otherwise in writing.
4. Scheduling, access and cancellation
Appointments are scheduled in arrival windows, not exact times, because job durations vary. We will contact you if we are running outside your window.
To perform the work you must provide safe and lawful access to the property, to the heating and cooling equipment, to the attic or crawl space where relevant, and to a working power supply. If you are not the owner of the property, you confirm you have the owner's permission for the work. Please clear access to vents and equipment before we arrive and secure pets.
You may cancel or reschedule at no charge up to 24 hours before the start of your arrival window. If our technician arrives and cannot begin because access was not available, no one was present, or conditions were unsafe, we may charge a trip fee, which we will tell you about before dispatching.
We may decline or stop work where conditions are unsafe, where the system is in a condition that cleaning would damage, where asbestos-containing material or a live pest infestation is suspected, or where the work requires a licence or discipline we do not hold. In that case we will explain why and charge only for work already performed.
5. Pricing and payment
Prices are quoted in United States dollars and exclude any applicable taxes unless stated. Payment is due on completion of the work unless we have agreed different terms in writing. We accept the payment methods our technician identifies at the time of service.
Any promotional price, coupon or advertised offer is subject to the conditions published with it, applies to standard residential systems unless stated, cannot be combined with other offers unless stated, and may be withdrawn at any time before an appointment is confirmed.
6. Workmanship and what we do not do
We perform our services in a professional and workmanlike manner using industry-accepted methods and equipment. Where we give a written workmanship commitment for a specific job, its terms are set out on your invoice and govern that job.
Duct cleaning is a maintenance service. It removes accumulated dust and debris from the accessible parts of your system. It is not a medical treatment, and we make no representation that it will cure, treat, prevent or alleviate any medical condition, allergy or respiratory illness. Any statement on the Site about air quality is general information, not a health claim about your home.
We are not responsible for pre-existing defects, for damage arising from the age or poor condition of ductwork, equipment or building materials that was not caused by our work, for concealed conditions we could not reasonably have discovered, or for the performance of equipment we did not install. Mold remediation, where offered, is performed to the scope agreed in writing and does not guarantee that mold will not recur if the underlying moisture source is not corrected.
7. SMS text messaging program terms
These terms govern the California Airduct Pros text messaging program and apply in addition to the rest of these Terms.
Program description
California Airduct Pros sends text messages relating to service enquiries, estimates, appointment scheduling, appointment reminders, technician arrival notifications, service follow-up, and occasional information about our services.
How you opt in
You opt in by checking the consent box on a form on this Site and submitting your telephone number, by texting us first, or by giving your number to our staff and asking to be contacted by text. Consent to receive marketing text messages is not a condition of purchasing any goods or services. You may request an estimate without agreeing to receive text messages, by telephone or email.
Message frequency
Message frequency varies. You should expect messages relating to an active enquiry or a scheduled appointment, and occasional service messages thereafter.
Cost
Message and data rates may apply. These are charged by your mobile carrier and are your responsibility. Check your mobile plan for details.
How to opt out
You can cancel at any time by replying STOP to any message from us. We will send one final message confirming that you have been unsubscribed, and after that you will receive no further text messages from us. To rejoin, opt in again using any of the methods above.

Carriers and liability
The program is supported by major mobile carriers in the United States, including AT&T, Verizon Wireless, T-Mobile, and their affiliates and regional carriers. Carriers are not liable for delayed or undelivered messages. Delivery is subject to effective transmission by your carrier and is not guaranteed.
Eligibility and your number
You must be at least 18 years old and the account holder of, or authorised to give consent for, the mobile number you provide. If you change or give up that number, you must tell us promptly, so that we do not message someone who has not consented.
Privacy
No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. Information sharing with subcontractors who provide support services, such as customer service providers, is permitted. All other use case categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties. See our Privacy Policy.
8. Telephone calls and recording
By providing your telephone number and checking the consent box, you agree that we and our service professionals may contact you at that number about your request, including by automatic telephone dialling system, prerecorded or artificial voice, and text message. Consent is not a condition of purchase, and you may revoke it at any time by any reasonable means, including by telling us on a call, replying STOP to a text, or emailing us.
California is a two-party consent state under Penal Code section 632. Where we record a call, we will notify you at the beginning of the call. If you do not wish to be recorded, tell us and we will stop the recording or continue the conversation in writing.
You may ask to be added to our internal do-not-call list at any time, and we will keep that request on file.
9. Acceptable use of this website
You agree not to:
- Submit false, misleading or fraudulent information, or a telephone number you are not authorised to provide.
- Use the Site or its forms to send advertising, solicitations or spam, including unsolicited commercial offers sent through our contact forms.
- Attempt to gain unauthorised access to the Site, its servers or any connected system, or probe or test its vulnerability.
- Use any robot, scraper or automated means to access, copy or harvest content or contact details from the Site.
- Interfere with the proper working of the Site, including by overloading our forms or introducing malicious code.
- Use the Site for any unlawful purpose or in breach of any applicable law.
We may suspend or block access to anyone who breaches this section.
10. Intellectual property
The Site and its contents — including text, photographs, graphics, layout, design and the California Airduct Pros name and logo — are owned by us or our licensors and are protected by copyright, trademark and other laws. You may view and print pages for your own personal, non-commercial use. You may not copy, reproduce, republish, distribute or create derivative works from the Site without our prior written permission.
11. Reviews, photographs and testimonials
If you send us a review, photograph, comment or other content, you grant us a non-exclusive, royalty-free, worldwide licence to use, reproduce and display it in connection with our business, including on the Site and on our social media pages. You confirm the content is yours to give and does not infringe anyone's rights. We may decline to publish, or remove, any content at our discretion. We do not offer payment or discounts in exchange for reviews, and we do not publish reviews we know to be false.
Photographs of completed work may be taken for documentation and quality assurance. If you do not want photographs of your property used in our marketing, tell the technician or contact us, and we will not use them for that purpose.
12. Third-party links
The Site may link to third-party websites, including our listings on Google, Facebook and Instagram. We do not control those sites and are not responsible for their content, products or privacy practices. Links are provided for convenience and are not an endorsement.
13. Disclaimers
The Site and its content are provided "as is" and "as available." To the fullest extent permitted by law, we disclaim all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, title and non-infringement, with respect to the Site.
Information on the Site about air quality, ventilation, mold, wildfire smoke, building codes and maintenance intervals is general information for California property owners. It is not professional, medical, legal or engineering advice, and it may not reflect the most recent changes in codes or standards. Do not rely on it as a substitute for advice about your specific property. Nothing in this section limits any warranty we expressly give in writing for services actually performed, or excludes liability that cannot be excluded by law.
14. Limitation of liability
To the fullest extent permitted by law, neither we nor our officers, employees or contractors will be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for loss of profits, revenue, data, goodwill or business interruption, arising out of or in connection with your use of the Site, whether based in contract, tort, strict liability or otherwise, even if we have been advised of the possibility of such damages.
Our total aggregate liability arising out of or relating to your use of the Site will not exceed one hundred United States dollars (US$100). Liability arising out of services we actually performed is governed by the agreement for those services and by applicable California law, and is not limited by this section.
Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot lawfully be excluded or limited. Some jurisdictions do not allow certain exclusions or limitations, so parts of this section may not apply to you.
15. Indemnification
You agree to indemnify and hold harmless California Airduct Pros and its officers, employees and contractors from any claim, demand, loss or expense, including reasonable legal fees, arising out of your breach of these Terms, your misuse of the Site, your provision of a telephone number you were not authorised to provide, or your violation of any law or third-party right.
16. Disputes, arbitration and governing law
Informal resolution first
If you have a concern, contact us first on +1 (866) 311-8118 or at info@californiaairductpros.com. Most issues are resolved quickly. Both of us agree to attempt to resolve a dispute informally for at least 30 days before starting formal proceedings.
Binding individual arbitration
If we cannot resolve a dispute informally, you and we agree that any dispute arising out of or relating to these Terms, the Site, or our services will be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, rather than in court. Arbitration will take place in the county in California where the services were performed or where you reside, or by telephone or videoconference at your election. The arbitrator's award may be entered as a judgment in any court of competent jurisdiction.
Class action waiver. Disputes will be arbitrated only on an individual basis. You and we each waive the right to participate in a class, collective, consolidated or representative action. This waiver does not apply to any claim for public injunctive relief, which may be brought in court to the extent that a waiver of such relief is unenforceable under California law.
Exceptions and your right to opt out
Either of us may bring an individual claim in small claims court instead of arbitration, and either of us may seek injunctive relief in court to protect intellectual property rights.
You may opt out of this arbitration agreement by emailing info@californiaairductpros.com with the subject line "Arbitration Opt-Out," together with your name and the telephone number or email address you used with us, within 30 days of first accepting these Terms. Opting out will not affect any other part of these Terms and will not affect your relationship with us in any way.
Governing law and venue
These Terms are governed by the laws of the State of California, without regard to its conflict of laws rules. Subject to the arbitration agreement above, the state and federal courts located in California have exclusive jurisdiction. Nothing in this section deprives you of the protection of mandatory consumer protection provisions of the law of the place where you reside, including the California Consumers Legal Remedies Act.
Where a user accesses the Site from Israel, nothing in these Terms limits any mandatory right that user has under Israeli consumer protection or privacy law, and any such mandatory right applies in addition to these Terms.
17. General provisions
- Changes. We may update these Terms. The "Last updated" date will change, and material changes will be notified on the Site. Continued use after a change means you accept the revised Terms. Changes do not apply retroactively to a dispute of which we already had notice.
- Severability. If any provision is held unenforceable, the rest remains in effect and the unenforceable provision is modified to the minimum extent necessary.
- No waiver. Our failure to enforce any provision is not a waiver of it.
- Assignment. You may not assign these Terms without our consent. We may assign them in connection with a merger, acquisition or sale of assets.
- Entire agreement. These Terms and the Privacy Policy are the entire agreement between us regarding the Site, and replace any prior understanding on that subject. A signed written agreement for specific services prevails over these Terms to the extent of any conflict.
- Force majeure. We are not liable for delay or failure caused by events beyond our reasonable control, including fire, flood, wildfire, earthquake, severe weather, power failure, labour disruption or government action.
